Wage Garnishment In Georgia? King & King Can Help.

If you are facing wage garnishment, it can be hard. If you’re already under pressure financially, the added pressure may mean you no longer are able to buy groceries or pay for essentials like gas to get to work. At King & King we understand and may be able to help you.

If a creditor is garnishing your wages, we can stop the wage garnishment with a bankruptcy filing. In some cases, we may even be able to recover some of the garnished wages after we file your case.

When you file for bankruptcy, an automatic stay goes into effect. Before a creditor can resume collection efforts, they must ask a court to lift a stay. The creditor must have a valid reason for lifting a stay. Most creditors would not be able to get the stay lifted. Therefore, your wages would be protected as you work your way through the bankruptcy court.

If your debt is discharged by the bankruptcy court, the creditor cannot resume garnishment to collect the debt. If your case gets dismissed without a discharge, the creditor can take steps to reinstate the wage garnishment following the dismissal.

If your garnishments were within a 90-day period prior to your bankruptcy filing, the amount garnished was more than $600, and you have enough exemptions to cover them, we may be able to recover and return some of the garnishment proceeds.

By working with your experienced King & King bankruptcy attorney, you can stop wage garnishments and reclaim your financial freedom. Call our office today at 404-524-6400 and find out how we can help you.

Considering Bankruptcy? This Is What You Should Know.

Filing for bankruptcy is a serious decision. Our attorneys at King & King understand that and are here to help. We will present you all your options and help you decide which bankruptcy will work best for you. Here are some common reasons why someone may consider filing for bankruptcy:

  1. Overwhelming debt: If your debts are so high that you cannot realistically see a way to repay them, even if you were to stop using your credit cards and tighten your budget, bankruptcy may be a good option.

  2. Constant harassment from creditors: If you are being constantly pursued by creditors or debt collectors, bankruptcy can help provide relief from this harassment.

  3. Threat of wage garnishment or property seizure: If your creditors have obtained a court judgment against you and are threatening to garnish your wages or seize your property, bankruptcy can help protect these assets.

  4. Unexpected life events: If you have suffered a significant setback such as a job loss, medical emergency, or divorce, bankruptcy may be a good option if you cannot manage your debts.

What Type Of Bankruptcy Is Right For You?

Chapter 7 bankruptcy is often referred to as a "liquidation" bankruptcy, as it involves selling certain assets to pay off debts. Chapter 7 is typically best suited for individuals with few assets and a large amount of unsecured debt, such as credit card debt or medical bills.

If you are considering Chapter 7 bankruptcy, here are some factors to keep in mind:

  1. Eligibility: You must pass a means test to determine if you are eligible to file for Chapter 7 bankruptcy. This test compares your income to the median income in your state and considers your expenses and debts.

  2. Exemptions: Some assets, such as your home, vehicle, and personal belongings, may be protected under state and federal exemptions.

  3. Timing: The process of Chapter 7 bankruptcy typically takes about 4-6 months from start to finish.

Here are some factors to consider if you are thinking about Chapter 13 bankruptcy:

  1. Eligibility: To be eligible for Chapter 13 bankruptcy, you must have a regular income and your debt must fall within certain limits.

  2. Repayment plan: In Chapter 13 bankruptcy, you will propose a repayment plan to repay a portion of your debts over a three-to-five-year period. This plan must be approved by the bankruptcy court.

  3. Protection of assets: Chapter 13 bankruptcy allows you to keep your assets, such as your home and vehicle, as long as you make the payments required under your repayment plan.

  4. Timing: The process of Chapter 13 bankruptcy typically takes three to five years from start to finish.

If you are considering bankruptcy, call the bankruptcy attorneys at King & King who can evaluate your specific financial situation and help you determine the right option for you. Call Today at 404-524-6400.

Why Is Bankruptcy The Right Choice For You?

So many people in Georgia are struggling in debt today. Covid, the economy, and unexpected life events are just a few of the reasons. Bankruptcy allows you to obtain debt relief and gives you a second chance to rebuild your finances. Here are a few of the top reasons to consider bankruptcy.

1. Bankruptcy Can Stop The Creditors From Calling.

Filing bankruptcy in Atlanta will stop the lawsuits, harassing calls at home and work, and the threatening letters.  When you file bankruptcy, the automatic stay stops all collection actions from creditors.  If they violate the automatic stay, you have a right to sue them in bankruptcy court for that violation.

2. Bankruptcy Can Wipe Out Your Debt.

Chapter 7 bankruptcy can clear your unsecured debt (credit card, loans, medical debt, etc.) to zero. Qualification for chapter 7 bankruptcy is determined by the Means Test. Chapter 13 Bankruptcy will allow you to restructure your debt and keep your home, car, and other property. Your bankruptcy attorney will help decide which is best for you and answer any questions you have.

3. Filing Bankruptcy Can Be The Fastest Way To Rebuild Your Credit.

This is a benefit that most people do not know about. After you receive your discharge, you can start to rebuild your credit.  Opening a secured credit card, using it and paying off the balance every month can raise your credit score to the high 600’s within 1 year of your bankruptcy case.  Next opening a unsecured credit card, using it and paying off the balance every month can raise your credit score above 700.

If you are struggling with debt and think that filing for bankruptcy is your right choice, the Atlanta bankruptcy attorneys at King & King can help. We have helped thousands of clients file for bankruptcy successfully. Contact us today at 404-524-6400 for a free consultation.

Can I Lose My Home If I File Bankruptcy?

When deciding to file bankruptcy one of the most important questions to consider is whether or not you will lose your home. The first thing to understand are the two main types of bankruptcy, chapter 7 & chapter 13.

Chapter 7 Bankruptcy

In Chapter 7 bankruptcy, you can wipe your debts clean and get a fresh start. In this type of bankruptcy, you liquidate your assets and sell them apart from any exempted assets. Your trustees then distribute the proceeds of the assets. It can be possible to lose your home under chapter 7 bankruptcy.  If you own a home and are planning to file chapter 7 bankruptcy, it is important that you consult with an experienced bankruptcy attorney.

Chapter 13 Bankruptcy

Chapter 13 proposes a repayment plan that lasts for three to five years.  Chapter 13 bankruptcy can help you save your home.  As long as you can stick to the repayment plan, all the remaining dischargeable debts are released after the repayment plan and there should be no danger of losing your home.

Keeping up with your overdue payments for certain obligations is another advantage of filing under Chapter 13. This includes home mortgages. This will allow you to gain ground on your payments for up to sixty months and prevent the foreclosure of your home or seizure of your assets.

If you are looking to file bankruptcy, we can help. The Atlanta bankruptcy attorneys at King & King  can assess your case and walk you through the impact bankruptcy would have on your home. Call us today at 404-524-6400 for a free consultation.

How Does a Chapter 13 Bankruptcy in Georgia Work?

In Georgia, like many states, people have continued to struggle with how to stay on top of their debt despite the healthy economy over the last several years. For some people, debt is due to excessive medical costs, job loss, divorce, death of family member, or one of many other factors. Filing for bankruptcy offers the chance to start over and be free of debt.

There are two main forms of personal bankruptcy, Chapter 7 and Chapter 13. A Chapter 13 bankruptcy plan is essentially a form of organized repayment. If you file Chapter 13, you must have sufficient income to qualify and make monthly payments to a trustee for a period of time lasting between 36 and 60 months. The monthly payments are used by the trustee to in turn make payments to creditors. The amount eventually repaid to creditors may be significantly less than what was originally owed and is determined at the outset of the bankruptcy plan. Consumers do not lose their assets in a Chapter 13 plan. A Chapter 13 bankruptcy also puts an automatic stay on foreclosure proceedings and stops vehicles from getting repossessed.

Our Atlanta debt relief attorneys know what you’re going through, and they’re ready to help. Call King & King at 404-524-6400 today to schedule a free consultation with an attorney.

How Can Bankruptcy Stop Foreclosure In Georgia?

Many people who are considering bankruptcy fear that they will lose the things that they hold most dear when they file. One of the biggest of these worries is whether you can keep your home, especially if the home is in danger of foreclosure.

Bankruptcy can stop foreclosure, and it is possible for you to keep your home.

The Automatic Stay
One of the benefits of filing for bankruptcy is the automatic stay. In both Chapter 7 and Chapter 13 bankruptcy filings, the automatic stay is a court-ordered injunction that begins as soon as the bankruptcy case has been filed. The automatic stay stops all collection actions by creditors against the debtor. Foreclosure proceedings are included in that group of collection actions that are stopped.

Chapter 13 Bankruptcy

Chapter 13 bankruptcy proceedings allow you to repay past-due mortgage payments a little bit at a time over several years rather than forcing a lump sum up front. If you can remain current on the monthly plan and mortgage payments, you should be able to keep your home.

Contact King & King For a Free Consultation Today
An experienced Georgia bankruptcy lawyer can help you determine the best way to stop a foreclosure, help you utilize the best exemptions to protect your property, and can help address any concerns you have about the bankruptcy process.

Call King & King today at 404-524-6400 to schedule a free consultation to discuss how bankruptcy may help you.

What Should I Do If My Wages Are Being Garnished?

What Should You Do If Your Wages Are Being Garnished In Georgia?

We understand wage garnishment causes serious hardship and make it impossible to get back on top financially. If you are currently being subjected to wage garnishment, bankruptcy could be a solution. Here are a few tips to help you stop wage garnishment.

When can your wages be garnished?

A creditor has to successfully sue you in court before they can obtain a wage garnishment against you. When that occurs, your creditor must then notify the sheriff’s office where you live and provide official paperwork proving the ruling against you. The sheriff’s office will then contact your employer, who must garnish your wages.

Will I be told in advance that my wages are going to be garnished?

In most cases you will know a wage garnishment is going to happen either by attending the hearing about your debt or by receiving a letter that a creditor has won a judgment against you. If you miss notification by the court you may told by your employer.

What can I do if my wages are garnished?

Your creditor will continue garnishments until your debt is repaid if you don’t take action. One effective way to immediately stop wage garnishments is to file bankruptcy. When you file for bankruptcy, you get an automatic stay, which stops all collections, including garnishments. If the debt is charged off or otherwise addressed during bankruptcy, the garnishment cannot be restarted, even when the bankruptcy ends.

At King & King bankruptcy attorneys we have been helping people in the state of Georgia stop wage garnishment for over 40 years. Call us today for a free consultation at 404-524-6400. We can help you get the fresh start you deserve.

Four Options For Eliminating Credit Card Debt In Georgia.

Credit card debt can quickly become overwhelming. Fortunately, you don’t have to live with credit card debt forever. King & King can help you eliminate your debts and put you on a path to a brighter financial future.  Here are a few strategies for climbing out of credit card debt.

Make a Budget

If your credit card debt is growing but not yet overwhelming, and you have a steady income that is adequate to your needs, you may be able to get out of debt by creating a budget. Put a larger amount of your income towards your credit card balance until the card is paid off. For this strategy to work, put a hold on making any new purchases on your cards.

Consolidate Your Cards

If you have good credit, you may be able to sign up for a new card that offers 0% interest for an introductory period. Transferring your existing balances to such a card can be an excellent strategy for cutting down your credit card debt. If you can’t open a new card with a 0% interest rate, consider consolidating as much of your debts as possible onto whichever card has the lowest interest rate. This will enable you to reduce the rate at which your debt will grow while you attempt to repay it.

Work Out a Debt Settlement

If your credit card debt has already gone into collections, you can consider working out a debt settlement with the collection agency. If you can repay 50 percent of the balance within a year or two, the collection agency may accept your offer.

File Chapter 7 Bankruptcy

Chapter 7 bankruptcy will completely wipe out your unsecured debts including credit card debts and stop creditors from contacting you. You can typically complete a Chapter 7 bankruptcy without liquefying your personal assets. If you decide to pursue bankruptcy, be sure to hire a bankruptcy attorney to help you.

If you’re tired of living with debt, if you feel like there’s no way out but you need help, then today is the day to call King & King at 404-524-6400 for a free consultation. We are experts in helping people just like you find the best way to move forward from being overwhelmed with debt.

Will Anyone Know If I file For Bankruptcy In Georgia?

At King & King, we’ve worked with many clients who worry about declaring bankruptcy. They may not be sure what the short-term and long-term effects will be, they’re afraid it may be too difficult to file, or they worry that filing bankruptcy may take too long. One question we get asked quite often during our free consultation is: Will anyone know if I declare bankruptcy?

Your bankruptcy won’t be publicized

The bottom line is that although your bankruptcy will be public record, it’s not advertised in a newspaper. Just remember you’re not alone, thousands of people in the U.S. file bankruptcy every day. If you’re having financial problems that are seriously impacting your life, don’t let your privacy concerns be the only reason you don’t get a fresh start and a better future.

Your creditors will be notified

No matter if you file Chapter 7 or Chapter 13 bankruptcy, the only people that will be notified are your creditors. The bankruptcy court sends out official forms that notify them you’ve filed. This gives you an automatic stay on all debt collection, which means that your creditors will no longer be able to collect from you. No more phone calls at work, no more letters at home – bankruptcy stops collections.

Your bankruptcy will be public record

Your bankruptcy filing will be public record. Bankruptcy records are available through a website run by the Federal Court System. In order for one to find bankruptcy records, users must apply for an approved ID and password. Once they have those, they must pay a fee to search for bankruptcy filings. Searching for a bankruptcy is an incredibly tedious process.

King & King will file your bankruptcy quickly and correctly while putting a stop to creditors. We serve clients in Atlanta and throughout the state of Georgia. To schedule a free consultation, call King and King bankruptcy attorneys at 404-524-6400 or visit us at www.kingandkingattorneys.com

There are a few things you need to bring to the meeting with your lawyer. Take the time to collect the following:

Information about your creditors

If you are being sued by a creditor or if you have received letters from creditors, bring these to your initial meeting as well.
